1. Acceptance of Terms
By accessing or using the SmartHeal platform (the "Service"), including the website at www.smartheal.org and the application at app.smartheal.org, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
SmartHeal is a Clinical Decision Support System (CDSS) for objective wound measurement and documentation. The Service provides AI-assisted wound imaging, and wound documentation. SmartHeal does not diagnose or suggest treatment. All AI-generated findings must be reviewed and verified by a qualified healthcare professional before use in clinical decisions.
3. Eligibility
You must be a qualified healthcare professional or authorised personnel of a healthcare facility to use the Service for clinical purposes. You represent that you have the authority to bind your organisation to these Terms where applicable.
4. Account and Registration
You must register for an account to access the platform. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and notify us promptly of any unauthorised access.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with applicable clinical and regulatory requirements. You must not:
- Use the Service in a manner that violates any applicable law or professional standards
- Rely on AI outputs without appropriate clinical verification
- Share account credentials or allow unauthorised access
- Attempt to reverse-engineer, copy, or extract the Service or its underlying technology
- Use the Service to process data in violation of patient consent or privacy obligations
6. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. Data is hosted in AWS Sydney. We handle personal and health information in accordance with the Australian Privacy Principles (APPs).
7. Intellectual Property
SmartHeal and its content, branding, and technology are owned by SmartHeal or its licensors. You may not use our trademarks or content without prior written consent. You retain ownership of data you input; you grant us a limited licence to process it to provide the Service.
8. Disclaimers
Clinical Disclaimer: SmartHeal is a Clinical Decision Support System intended for objective measurement and documentation support only. It does not diagnose or suggest treatment. All AI-generated findings must be reviewed and verified by a qualified healthcare professional. The clinician retains full responsibility for patient care decisions.
Service "As Is": The Service is provided "as is" and "as available." We do not warrant uninterrupted, error-free, or secure operation. We disclaim all warranties to the extent permitted by law.
9. Limitation of Liability
To the maximum extent permitted by applicable law, SmartHeal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim, or one hundred Australian dollars (AUD 100), whichever is greater.
10. Indemnification
You agree to indemnify and hold SmartHeal harmless from any claims, damages, or expenses arising from your use of the Service, your breach of these Terms, or your violation of any law or third-party rights.
11. Termination
We may suspend or terminate your access at any time for breach of these Terms or for operational reasons. You may terminate your account at any time. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnification) shall survive.
12. Changes
We may update these Terms from time to time. We will notify you of material changes via the Service or by email. Continued use after changes constitutes acceptance. The "Last updated" date at the top indicates when these Terms were last revised.
13. Governing Law
These Terms are governed by the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Australia.
